1. Acceptance of Terms

FinTrail is operated by FinTrail Limited, a company incorporated in Bangladesh under the Companies Act (Act XVIII) of 1994 (Reg. No. CH-16638/2026). By accessing or using FinTrail ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

FinTrail is a portfolio tracking and market analysis platform for the Dhaka Stock Exchange (DSE). The Service provides tools for tracking investments, viewing market data, technical analysis, price alerts, and community features. FinTrail is not a brokerage, financial advisor, or investment manager.

3. Eligibility

You must be at least eighteen (18) years of age and legally competent to enter into a binding contract under the laws of Bangladesh to use the Service. By creating an account, you represent that you meet these requirements.

4. User Accounts

When creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use
  • Not share your account with others

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Scrape, crawl, or use automated means to access the Service without permission
  • Post false, misleading, or manipulative content
  • Harass, abuse, or harm other users
  • Impersonate any person or entity

6. Subscription and Payments

FinTrail offers free and paid subscription plans. For paid plans:

  • Prices are stated in Bangladeshi Taka (BDT) and are inclusive of applicable Value Added Tax (VAT) unless stated otherwise
  • Payments are processed securely through our payment partners
  • Subscriptions renew automatically unless cancelled
  • You may cancel at any time; access continues until the billing period ends
  • Refund requests must be made within seven (7) days of payment; eligible refunds are processed within fifteen (15) working days to the original payment method
  • Prices may change with 30 days notice

7. Intellectual Property

The Service, including its design, features, and content, is owned by FinTrail Limited and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission. User-generated content remains yours, but you grant us a license to display it within the Service.

8. Third-Party Content

The Service displays market data, news headlines, corporate announcements, and links to third-party websites — including data sourced from the Dhaka Stock Exchange. FinTrail does not endorse and is not responsible for the accuracy, completeness, or availability of third-party content. Reliance on such material is at your own risk.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described therein.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. MARKET DATA IS PROVIDED FOR INFORMATIONAL PURPOSES AND MAY BE DELAYED OR INACCURATE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINTRAIL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR INVESTMENT LOSSES, ARISING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless FinTrail Limited, its directors, officers, and employees from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your use or misuse of the Service, your violation of these Terms, your violation of applicable law, or your infringement of any third-party right.

13. Investment Disclaimer

FinTrail does not provide investment advice. All information is for educational and informational purposes only. You are solely responsible for your investment decisions. Please read our full Investment Disclaimer.

14. Force Majeure

FinTrail is not liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, epidemics, civil unrest, hartals, government action, internet or telecommunications failures, power outages, DSE trading halts, or interruptions in third-party data feeds.

15. Termination

We may suspend or terminate your account for:

  • Violation of these Terms or our Acceptable Use policy
  • Non-payment of subscription fees
  • Request by a competent Bangladeshi authority
  • Prolonged inactivity exceeding twelve (12) months on a free account

Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through your account settings.

16. Modifications to Terms

We may update these Terms from time to time. Material changes will be notified by email to your registered address and posted within the Service at least fifteen (15) days before they take effect. Non-material changes are effective upon posting. Your continued use of the Service after the effective date constitutes acceptance.

17. Notices

Notices from FinTrail to you will be delivered by email to the address registered with your account or posted within the Service, and shall be effective twenty-four (24) hours after sending. Notices from you to FinTrail should be sent to support@fintrail.net or by registered post to our registered office in Chattogram.

18. Dispute Resolution and Governing Law

These Terms are governed by the laws of Bangladesh. Before initiating any legal proceeding, both parties shall attempt in good faith to resolve any dispute through written notice and amicable negotiation for at least fifteen (15) days. If unresolved, the courts of Chattogram, Bangladesh shall have exclusive jurisdiction.

19. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force. These Terms, together with the Privacy Policy and Investment Disclaimer, constitute the entire agreement between you and FinTrail regarding use of the Service. You may not assign your rights under these Terms without our prior written consent; FinTrail may assign these Terms in connection with a merger, acquisition, or sale of assets. No failure to enforce any provision shall constitute a waiver.

20. Language

These Terms are published in English and Bengali. In case of any conflict between the two versions, the English version shall prevail for purposes of interpretation.
